Terms of Service

These Terms govern your access to and use of Apex SMC, the XAUUSD Sniper SMC TradingView indicator, our website, dashboards, and any related services. Please read them carefully before creating an account.

Apex SMC is an analytical and educational technology service. It is not a broker, dealer, investment adviser, or portfolio manager. Nothing on this site or within our indicator constitutes personalised investment advice or a solicitation to buy or sell any financial instrument.

1. Acceptance of these Terms

These Terms of Service (“Terms”) form a binding agreement between you (“you”, “your”, “Member”) and Apex SMC (“Apex SMC”, “we”, “us”, “our”). By creating an account, subscribing to a plan, or accessing any part of the Apex SMC service (the “Service”), you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Risk Disclaimer and Refund Policy.

If you do not agree to any part of these Terms, you must not use the Service. We may update these Terms from time to time; updates take effect when posted on this page with a new “Last updated” date.

2. Eligibility and Accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
  • You must provide accurate, current and complete information when you register, including a valid TradingView username for indicator whitelist access.
  • You are responsible for all activity that occurs under your account and for keeping your credentials confidential. Notify us immediately at security@apexsmc.io of any unauthorised access or suspected breach.
  • Apex SMC may suspend, restrict or terminate accounts that violate these Terms, applicable law, or that present a security or fraud risk.

3. Licence to the Indicator

Subject to your continued compliance with these Terms and payment of all applicable fees, Apex SMC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the XAUUSD Sniper SMC indicator on TradingView strictly through the single TradingView username linked to your account.

What you may not do

  • Share, sell, sublicense, rent, lease, lend or otherwise distribute access to the indicator, its outputs, source code, scripts or visual artefacts.
  • Whitelist additional TradingView usernames against a single subscription without a written upgrade or multi-seat agreement.
  • Reverse engineer, decompile, disassemble, copy, modify, scrape or create derivative works of the indicator or any other proprietary materials of Apex SMC.
  • Use the Service to provide a similar or competing service, to train any machine-learning model, or in any manner that violates applicable law.

4. Subscriptions, Billing and Renewal

  • Plans, prices and features are described on the pricing page. All amounts are stated in the currency shown at checkout and are exclusive of any taxes, duties or fees imposed by your jurisdiction unless explicitly stated.
  • Unless you cancel beforehand, subscriptions renew automatically at the end of each billing period at the then-current rate. You authorise us (and our payment processors) to charge your chosen payment method on each renewal date.
  • You can cancel future renewals at any time from your account dashboard or by emailing billing@apexsmc.io. Cancellation takes effect at the end of the current paid period; the indicator whitelist is removed when the period ends.
  • Refunds, where applicable, are governed by our Refund Policy.

5. Acceptable Use

You agree not to, and not to permit any third party to:

  • Use the Service for any unlawful, fraudulent, deceptive, abusive, or harmful purpose.
  • Interfere with or disrupt the integrity, performance or security of the Service, including by deploying malware, denial-of-service traffic, automated scraping or vulnerability probing without written permission.
  • Bypass, attempt to bypass, or assist others in bypassing any technical, licensing, billing or rate-limit controls of the Service.
  • Misrepresent your affiliation with Apex SMC, post defamatory content, or impersonate any person or entity in your interactions with our team or community channels.

6. Intellectual Property

Apex SMC and its licensors retain all right, title and interest in and to the Service, including the indicator source, signal logic, brand marks, software, content, layouts, dashboards and documentation. No rights are granted to you by implication, estoppel or otherwise other than those expressly stated in these Terms.

You retain ownership of content you submit (for example support tickets, feedback or reviews). By submitting content you grant Apex SMC a worldwide, royalty-free, perpetual licence to use, reproduce, modify and display that content to operate and improve the Service. You must not submit content that you do not have the right to share.

8. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Apex SMC and its affiliates disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, and freedom from errors.

We do not warrant that the indicator, dashboard or signals will be available without interruption, free of defects, or that they will achieve any particular result, return, win-rate or risk-reward outcome.

9. Limitation of Liability

To the maximum extent permitted by law, Apex SMC, its officers, employees, contractors, affiliates and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, trading losses, lost revenues, lost goodwill, lost data, business interruption, or substitute services, arising out of or in connection with your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (i) the fees you paid to Apex SMC in the twelve (12) months immediately preceding the event giving rise to the claim or (ii) one hundred United States dollars (USD 100). Some jurisdictions do not permit the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to defend, indemnify and hold harmless Apex SMC and its officers, employees, contractors, affiliates and licensors from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, including any intellectual property or privacy right, or (d) your trading activity or financial decisions.

11. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, presented a security or compliance risk, or failed to pay fees when due. Upon termination, the licence granted to you ends immediately and your TradingView whitelist will be removed.

You may stop using the Service and close your account at any time. Sections that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnification and dispute resolution) will survive termination.

12. Changes to the Service

We are continually improving Apex SMC. We may add, change or remove features, signals, dashboards or documentation at any time. We will use reasonable efforts to notify you of material changes that adversely affect a paid feature you currently use.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Apex SMC is registered, without regard to its conflict of laws principles. Any dispute, claim or controversy arising out of or relating to these Terms or the Service will first be addressed through good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit to the exclusive jurisdiction of the competent courts of the same jurisdiction, except where mandatory consumer protection laws in your country of residence provide otherwise.
