1. No financial advice
Apex SMC is a technology company. We publish quantitative signals, indicator overlays and educational material based on Smart Money Concept (SMC) methodology. We are not a broker, dealer, investment adviser, financial planner, portfolio manager or regulated financial services firm in any jurisdiction.
Nothing on this website, in the indicator, in any signal, or in any communication from our team constitutes personalised investment advice or a solicitation to buy or sell any financial instrument. You must make your own decisions and, where appropriate, consult a licensed professional.
2. The risks of trading XAUUSD and leveraged instruments
- Volatility risk — gold and forex prices can move sharply within seconds, especially around news, session opens, and macro releases. Stop-loss orders may not be filled at the specified price during fast markets.
- Leverage risk — leverage magnifies both gains and losses. A small adverse move can wipe out your capital and, with some brokers, result in a balance below zero (unless negative-balance protection is offered).
- Liquidity and slippage risk — order execution may differ from screen quotes due to spread widening, slippage, requotes, gap risk or technical failures at your broker.
- Counter-party risk — your broker, payment processor or exchange may fail, default or freeze withdrawals. Choose regulated counter-parties.
- Technology risk — internet outages, platform errors, indicator delays, charting bugs and cyber incidents can cause missed opportunities or losses. Always have a manual contingency.
- Regulatory risk — leveraged trading is restricted or prohibited in some jurisdictions. You are responsible for confirming that your use of leveraged markets is lawful where you live.
3. Past performance is not indicative of future results
Any historical results, win-rate statistics, risk-reward ratios, equity-curve illustrations, screenshots, backtests, or testimonials shown on our website or in marketing materials describe what has happened in the past on specific instruments under specific conditions. Past performance is not a reliable indicator of future performance.
Hypothetical or simulated performance has inherent limitations. Unlike a real-money track record, simulated results do not reflect actual trading, broker execution, slippage, fees, taxes, emotional behaviour or other real-world frictions that materially affect outcomes.
4. Your responsibility
By using Apex SMC, you acknowledge and agree that:
- You are the sole decision-maker for every order you place on your trading account.
- You will only risk capital you can afford to lose entirely without affecting your standard of living or financial obligations.
- You are responsible for understanding your broker's execution model, fees, leverage caps, margin calls and stop-out rules.
- You will use risk-management practices appropriate for your situation, including position sizing, stop losses and exposure limits.
- You will not hold Apex SMC, its team or its licensors liable for any direct, indirect, incidental, consequential or other losses arising from your trading decisions.
5. Testimonials
Testimonials on our website are submitted voluntarily by real members. They describe individual experiences and are not representative of all members. Members were not compensated for their testimonials. Individual results vary widely based on capital, risk per trade, execution discipline, broker conditions and personal psychology.
6. Jurisdictional notice
The content of this website and the Service are not directed at, and are not intended for distribution to or use by, any person in any jurisdiction where such distribution or use would be contrary to local law or regulation, or where Apex SMC is not authorised to operate. It is your responsibility to inform yourself of and observe any restrictions applicable to you.
7. Updates
We may update this Risk Disclaimer from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Service after an update constitutes acceptance of the revised disclosure.
