Privacy Policy

This policy explains what personal information Apex SMC collects, why we collect it, how we use and share it, and the rights you have over it.

We do not sell your personal information. We collect only what is necessary to provide the Service, comply with the law, and keep your account secure.

1. Who we are

Apex SMC (“Apex SMC”, “we”, “us”, “our”) is the data controller for the personal information processed in connection with our website, the XAUUSD Sniper SMC TradingView indicator and our member dashboard (collectively, the “Service”). You can contact our privacy team at privacy@apexsmc.io.

2. Information we collect

Information you provide directly

  • Account details — first name, last name, email address, password (hashed), TradingView username, and your communications preferences.
  • Billing details — chosen plan, billing currency, transaction identifiers, last four digits of the payment instrument, and the country associated with payment. Full payment card numbers are processed by our payment providers and never stored on Apex SMC servers.
  • Support content — tickets, attachments, and messages you exchange with our team via email, chat or the in-dashboard support center.

Information collected automatically

  • Device and usage data — IP address, browser type and version, operating system, referring URL, pages viewed, dashboard interactions and approximate location derived from IP.
  • Indicator activity — whitelist status, plan tier, last log-in to TradingView with the linked username, and high-level usage metrics. We do not access your TradingView trades or balances.
  • Cookies and similar technologies— used for session authentication, security, basic analytics and remembering preferences. See “Cookies” below.

3. How we use your information

  • To create and manage your account, including whitelisting your TradingView username.
  • To deliver the indicator, signals, dashboards, education content and customer support.
  • To process payments, manage subscriptions, prevent payment fraud and handle refunds.
  • To communicate operational notices such as billing receipts, security alerts and material changes to the Service, and — only with your consent — marketing or product updates you can opt out of at any time.
  • To detect, investigate and prevent abuse, security incidents or violations of our Terms of Service.
  • To comply with applicable legal, tax, accounting and regulatory obligations.
  • To improve and develop the Service, including aggregated and anonymised analytics.

5. Sharing of information

We share personal information only with the following categories of recipients:

  • Service providers and processors — payment processors, cloud hosting, email delivery, error monitoring, analytics and customer support tooling. Each is bound by written contracts requiring confidentiality and security.
  • TradingView — limited to your TradingView username (and where required, account email) to whitelist and revoke access to the indicator.
  • Law enforcement and regulators — when legally required, in response to valid legal process, or to protect rights, property and safety.
  • Corporate transactions — in connection with a merger, acquisition, financing or sale of assets, subject to standard confidentiality protections and notice where required.

We do not sell, rent or trade personal information for advertising purposes.

6. International transfers

Some of our service providers operate outside your country of residence. Where personal information is transferred internationally, we rely on appropriate safeguards such as Standard Contractual Clauses or equivalent mechanisms recognised by applicable data-protection law.

7. Data retention

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected:

  • Active accounts — for the duration of the account, plus a reasonable buffer to handle disputes, billing reconciliation and security investigations.
  • Closed accounts — anonymised or deleted within a commercially reasonable period, except where law requires longer retention (for example tax, accounting or AML records).
  • Support content — typically retained for up to 24 months for quality assurance, training and pattern analysis.

8. Security

We implement administrative, technical and physical safeguards designed to protect personal information, including encryption in transit, hashed credentials, principle-of-least-privilege access controls, vendor due-diligence and continuous monitoring. No system is perfectly secure; you also play a role by using a strong unique password and protecting access to your inbox and TradingView account.

9. Your rights

Depending on your jurisdiction, you may have the following rights regarding your personal information:

  • Access — request a copy of personal information we hold about you.
  • Correction — request that we update inaccurate or incomplete information.
  • Deletion — request that we delete information we no longer need to retain.
  • Portability — request a structured export of information you provided to us.
  • Objection / restriction — object to or restrict certain processing based on legitimate interests.
  • Withdrawal of consent — withdraw consent for any processing based on consent at any time.
  • Complaint — lodge a complaint with the supervisory authority in your country (for example the ICO in the UK, your national DPA in the EEA, or another competent authority).

To exercise any of these rights, email privacy@apexsmc.io. We may need to verify your identity before responding and may not be able to fulfil requests that conflict with our legal obligations.

10. Cookies

We use a minimal set of cookies and similar technologies:

  • Strictly necessary — required for authentication, security and core dashboard functionality. These cannot be turned off.
  • Preferences — remember your settings such as theme or last-visited section.
  • Analytics — aggregated, privacy-respecting analytics to understand which features are most useful. Loaded only with your consent where required by law.

You can manage cookies through your browser settings. Blocking strictly necessary cookies will break parts of the Service.

11. Children

Apex SMC is not directed to individuals under the age of 18 (or the age of majority in your jurisdiction). We do not knowingly collect personal information from minors. If you believe we have collected information from a minor, contact us so we can delete it.

12. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be notified through the dashboard or by email where appropriate. The “Last updated” date at the top of this page reflects the most recent revision.
